Public Notice on Abandoned Trademark Applications

 

On February 6, 2023, the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM), Mumbai, issued a Public Notice through Trade Marks Journal No. 2090, stating that trademark applications which have not received a reply to the examination report within the prescribed time will be considered 'Abandoned' under Section 132 of the Trade Marks Act, 1999 and Rule 33(4) of the Trade Marks Rules, 2017.

The Notice clarifies that the Registry must issue a proper notice to the affected party before considering the application 'abandoned', and has also published a list of such applications for public view to ensure compliance with the Trade Marks Act and Rules.

Additionally, the Registry has given an opportunity to the Applicant or Applicant's agent of such applications, who have already responded to the Examination Report within the prescribed time, to submit the Non-cash receipt (NCR) or any other relevant document by email to the Registry on  within 30 days from the date of publication, to facilitate proper processing of the application as per the Act and Rules.
