Court restrains “INVEX” from using  trademark similar to “IMPEX”

The Ernakulam District Court has issued an injunction in favor of IMPEX, a renowned electronic & home appliance manufacturer & retailer, against INVEX, a company operating in the pillow and mattress industry. The court found that INVEX had adopted a strikingly similar logo to that of IMPEX, featuring an identical color scheme and a distinct design element in the letter “X.” 

Despite INVEX securing registration for their mark, the court determined that the adoption of the mark was done in bad faith, leading to consumer confusion due to the deceptive similarity. Highlighting IMPEX’s substantial market presence and well-known status, the court’s order restrains INVEX from using their trademark or any similar mark, pending the suit’s final disposal.
