Establishment of E-Adjudication Platform: MCA Notification - 05.08.2024

The Ministry of Corporate Affairs (MCA) has issued a crucial amendment to the Companies (Adjudication of Penalties) Rules, 2014, under G.S.R. 476(E). This amendment, effective from September 16th, 2024, introduces a significant shift towards digitalization in corporate compliance processes. Here are the key highlights:

  • Establishment of E-Adjudication Platform: Starting from September 16th, 2024, all proceedings conducted by adjudication officers and Regional Directors will exclusively take place online through the newly developed e-adjudication platform. This encompasses the issuance of notices, filing of replies, submission of documents and evidence, attendance of hearings, passing of orders, and payment of penalties.
  • Email Address for Notices: If a person’s email address is unavailable, the adjudicating officer will send the notice by post to the last known address. A copy of such notices will be maintained in the electronic record on the e-adjudication platform.
  • Default to E-Adjudication Platform: In cases where no address is available for the person concerned, the notice will be placed on the e-adjudication platform by default.

This transition to an electronic adjudication process is a landmark step in enhancing the efficiency, transparency, and accessibility of corporate regulatory procedures in India. It highlights the government’s commitment to utilizing technology to facilitate ease of doing business and ensure robust governance.
